This public offer for the provision of a charitable donation (hereinafter referred to as the "Offer") is addressed to an indefinite number of capable individuals and legal entities who voluntarily engage in charitable activities and are visitors of the website: https://yakir.org.ua/ (hereinafter referred to as the "Donor"). It constitutes a public proposal of the charitable organization “Zhytomyr City Public Organization ‘Yakir’” (registration code 26017417) (hereinafter referred to as the “Organization”), represented by the Chairwoman of the Board, Iryna Anatoliivna Linnik, acting under the Charter, to enter into an agreement with each Donor under the terms specified below.
1. Terms and Definitions
1.1. Public Offer – a valid offer from the Organization, posted on the Website, to make a charitable donation, addressed to an unlimited number of persons.
1.2. Acceptance – full and unconditional acceptance of this Public Offer by transferring funds using payment forms and tools posted on the Website, or by transferring funds to the Organization's bank account through banking institutions. The moment of Acceptance is considered the date the funds are credited to the Organization’s bank account.
1.3. Charitable Donation – a free transfer of funds by the Donor to the Organization for the achievement of the Organization’s statutory goals in accordance with the Law of Ukraine “On Charitable Activities and Charitable Organizations.”
2. Subject of the Agreement
2.1. This agreement regulates the free and voluntary transfer of funds by the Donor to the Organization for the implementation of its statutory purposes and programs.
2.2. The amount of the charitable donation is determined by the Donor independently.
2.3. The Parties confirm that fulfilling the conditions of this Offer is not intended for making a profit or gaining any benefits for either Party.
3. Acceptance of the Offer
3.1. Acceptance of the Offer means the Donor agrees with all of its terms, is acquainted with the Organization’s Charter (posted on the Website), and is aware of the purpose and goals of the public collection of charitable donations.
3.2. Upon acceptance, the charitable donation agreement is considered concluded in accordance with Articles 207, 639, 641, and 642 of the Civil Code of Ukraine.
4. Rights and Obligations of the Parties
4.1. The Organization undertakes to:
Use the received charitable donations for the realization of its statutory purposes and programs.​
Provide reports on the use of charitable donations in accordance with Ukrainian law.​
4.2. The Donor has the right to:
Receive information on how their charitable donation is used.​
Contact the Organization with questions concerning the use of donations.​
5. Other Provisions
5.1. This Public Offer enters into force from the moment it is published on the Website and remains valid until it is revoked by the Organization.
5.2. The Organization reserves the right to amend the terms of this Offer. Changes take effect from the moment they are published on the Website.
5.3. In case of disputes between the Organization and the Donor, they shall be resolved through negotiations, and if an agreement cannot be reached, in accordance with the current legislation of Ukraine.

6. Procedure for Making a Charitable Donation
6.1. The Donor independently determines the amount of the donation and may request from the Organization information on the nature and amount of charitable assistance needed for specific activities.
6.2. Charitable donations can be made by the Benefactor through:
6.2.1. Transferring funds using payment forms and tools posted on the Website;
6.2.2. Transferring funds to the Organization’s bank accounts via banking institutions
6.3. A payment is considered made at the moment a successful transaction is confirmed by the bank or payment system.
6.4. All costs associated with making donations (transfer fees, taxes, charges, etc.) are borne by the Donor if charged to them, or by the Organization if charged to it.
6.5. The Donor is responsible for the accuracy of the information provided during the transfer.
6.6. Donations are non-refundable. In exceptional cases, requests for refunding an erroneous transfer are reviewed individually.
